PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. BY ENTERING THE TRANSLINK TAP IN TO WIN SWEEPSTAKES (THE “CONTEST”), THE ENTRANT AGREES TO BE BOUND BY ALL THE TERMS AND CONDITIONS CONTAINED IN THESE CONTEST RULES. IF YOU DO NOT AGREE TO ALL OF THE TERMS AND CONDITIONS IN THESE CONTEST RULES, DO NOT ENTER THE CONTEST. FAILURE TO COMPLY WITH THESE TERMS AND CONDITIONS MAY RESULT IN DISQUALIFICATION AND/OR NULLIFY THE ENTRANT FROM PARTICIPATING IN THE CONTEST.

ELIGIBILITY AND PARTICIPATION

To be eligible for the Contest, an individual must be (a) a legal resident of the Province of British Columbia, and (b) 18 years of age or older at the time of entry.

Employees of the South Coast British Columbia Transportation Authority (“TransLink”), its subsidiaries, and their respective promotion and advertising agencies, as well as family members of such employees, and household members who reside at the same address as such employees are not eligible for the Contest.

The Contest is void where prohibited by law.

SPONSOR

The Sponsor of the Contest is TransLink, with an address at 400 – 287 Nelson’s Court, New Westminster, BC. V3L 0E7.

HOW TO ENTER AND CONTEST DEADLINES

The Contest will open on August 17, 2023 at 11:00 a.m. Pacific Time (PT) and will close on October 31, 2023 at 11:59 p.m. PT (the “Contest Period”).

Entry with purchase: You must have a valid Compass Card in order to enter with purchase. To participate, entrants may register at translink.ca/tapintowin (the “Contest Site”) by providing the entrant’s name, email address, phone number, Compass Card number and the CVN code on the back of the entrant’s Compass Card, together with the other information, if any, required to complete the entry form (the “Online Entrants”). Your phone number will only be used to contact you if you are a selected as a winner. You must read and accept these Contest rules and comply with the entry requirements of these Contest rules. Once registration has been completed by the Online Entrant and confirmed by TransLink (which requires confirmation and verification of entrant’s email address), Online Entrants will earn an entry for each eligible trip taken during the Contest Period, to a maximum of two entries per day during the Contest Period, using the Compass Card with which they registered for the Contest. For the purposes of these Contest rules, a trip is a complete transit journey using Compass fare media, regardless of the number of transfers.

Entry without purchase: NO PURCHASE NECESSARY. To enter, entrants may download and print an entry form at the Contest Site and mail the completed entry form, including the entrant’s name, phone number and email address, to: TransLink Head Office, Attention: Marketing, 400 – 287 Nelson’s Court, New Westminster, BC V3L 0E7 (the “Mail-in Entry”). Your phone number will only be used to contact you if you are selected as a winner. You must read and accept these Contest rules and comply with the entry requirements of these Contest rules. Entrants will earn one Mail-In Entry per entry form submitted by mail, to a maximum of two Mail-in Entries per day for the applicable period of each Weekly Prize Draw. Mail-In Entries must be postmarked during the Contest Period and received by TransLink by the date and time set out below for each Prize draw in order to be included in such Prize draw. Each Mail-In Entry must be mailed in separately. Mail-In Entries will be deemed to be received on the date actually received by TransLink.

Entries received by any other method than those described above will not be accepted. Entries generated by script, macro, robotic, programming or any other automated means are prohibited and will be disqualified. If it is discovered by TransLink (using any evidence or other information made available to or otherwise discovered by TransLink) that an entrant has attempted to use multiple names, multiple identities, multiple email addresses, and/or any script, macro, robotic, programming or any other automated or other means not in keeping with TransLink’s interpretation of the letter and/or spirit of these Contest rules to enter or otherwise participate in or to disrupt this Contest, then such entrant may be disqualified from the Contest in the sole and absolute discretion of TransLink.

Entries must be received by the date and time set out below for each draw to be held. All entries received after the cutoff date and time for a particular draw, regardless of method of submission, will be disqualified from such draw.

Multiple entrants are not permitted to use the same email address or Compass Card.

Limit:

Maximum of two (2) entries per day per person during the Contest Period, regardless of the method of entry.

Each submission must be the property of the entrant. The entrant agrees to indemnify TransLink and its subsidiaries from any and all copyright, trademark or other intellectual property infringement claims or liability which may arise with regard to the entrant’s submission. Entries must not include content that is unlawful, harmful, vulgar, obscene, hateful, discriminatory, or otherwise objectionable as determined by TransLink, in its sole discretion.

Entries become the property of TransLink and will not be returned. By submitting an entry for the Contest, the entrant grants TransLink a non-exclusive, worldwide, royalty-free right in perpetuity to use and reproduce the entry in any manner without further permission or remuneration.

TransLink and its subsidiaries are not responsible or liable for any entrant’s or potential entrant’s inability to access the Contest Site or the entry submission process, or use their Compass Card. TransLink and its subsidiaries are not responsible for lost, late, damaged, illegible, garbled, stolen, misdirected, misidentified, delayed, or incomplete entries, for any problems or technical or mechanical malfunction of the computer online systems, servers, access providers, computer equipment, software, failure of any entry to be received by TransLink on account of technical problems or traffic congestion on the internet or at any website, or inaccurate entry information, whether caused by equipment, programming used in this contest, human processing or otherwise, or any combination thereof.

PRIZES

There are a total of sixty-four (64) prizes available to be won by qualified Contest entrants:

  • thirty (30) Compass Monthly Pass prizes,

  • ten (10) Transit Merchandise prize packages,

  • ten (10) Stay + Play prize packages,

  • two (2) Electric Bike prizes,

  • two (2) Electric Scooter prize packages,

  • two (2) Car Sharing prize packages,

  • one (1) Bike Sharing prize package,

  • one (1) Vancouver Giants prize package,

  • one (1) Vancouver Whitecaps prize package,

  • one (1) BC Lions prize package,

  • one (1) Grouse Mountain prize package,

  • one (1) Science World prize package,

  • one (1) Vancouver City Seaplane Tour prize package, and

  • one (1) Grand prize

    • (together, “Prizes”, each a “Prize”) each consisting of the following, choice at the sole discretion of TransLink:

    1. Each Compass Monthly Pass Prize consists of:

      One (1) adult fare 3-zone Compass Monthly Pass for one (1) month.

      Each Compass Monthly Pass Prize has an approximate retail value of one hundred eighty-nine Canadian dollars and forty-five cents (CDN $189.45).

    2. Each Transit Merchandise Prize consists of the following transit-themed merchandise:

      1. one (1) T-shirt,

      2. one (1) backpack,

      3. one (1) pair of socks,

      4. one (1) hat, and

      5. one (1) water bottle.

      Each Transit Merchandise Prize package has an approximate retail value of two hundred Canadian dollars (CDN $200.00).

    3. Each Stay + Play Prize consists of:

      1. one (1) voucher for a one (1) night standard hotel stay (based on double occupancy),

      2. one (1) dining voucher/gift card,

      3. one (1) attraction voucher/gift card, and

      4. two (2) adult fare 3-zone Compass DayPasses for one (1) day.

      Each Stay + Play Prize package has an approximate retail value of one thousand Canadian dollars (CDN $1,000.00). The actual value of each Stay + Play Prize package will vary based on the base value of the hotel room night. All hotels, restaurants and attractions are in the Metro Vancouver Region.

    4. Each Electric Bike Prize consists of:

      One (1) Electric Bike (e-bike)

      Each Electric Bike Prize has an approximate retail value of two thousand five hundred Canadian dollars (CDN $2,500.00).

    5. Each Electric Scooter Prize consists of:

      1. one (1) EVOLV Terra Urban Machina e-scooter,

      2. one (1) Heritage Helmet, and

      3. one (1) Urban Rider Pack, which includes a foldable water bottle, scooter alarm, Odier phone holder, white Etook lock, and a tote bag.

      Each Electric Scooter Prize has an approximate retail value of one thousand nine hundred Canadian dollars (CDN $1,900.00).

    6. Each Car Sharing Prize consists of:

      One (1) voucher for one-time registration fee, annual car share operator/insurance fee and driving credit for an Evo car sharing membership.

      Each Car Sharing Prize has an approximate retail value of five hundred thirty-five Canadian dollars (CDN $535.00).

    7. Each Bike Sharing Prize consists of:

      One (1) $1,000.00 voucher for a Mobi by Shaw Go bike sharing membership and account credit.

      The Bike Sharing Prize has a value of one thousand Canadian dollars (CDN $1,000.00).

    8. The Vancouver Giants Prize package consists of:

      1. four (4) tickets to a Vancouver Giants home game,

      2. food and beverage voucher, and

      3. four (4) adult fare 3-zone Compass DayPasses for one (1) day.

      The Vancouver Giants Prize package has an approximate retail value of five hundred Canadian dollars (CDN $500.00).

    9. The Vancouver Whitecaps Prize package consists of:

      1. two (2) tickets to a Vancouver Whitecaps home game, and

      2. two (2) adult fare 3-zone Compass DayPasses for one (1) day.

      The Vancouver Whitecaps Prize package has an approximate retail value of four hundred Canadian dollars (CDN $400.00).

    10. The BC Lions Prize package consists of:

      1. two (2) tickets to the BC Lions 2023 end of season home game,

      2. two (2) BC Lions jerseys, and

      3. two (2) adult fare 3-zone Compass DayPasses for one (1) day.

      The BC Lions Prize package has an approximate retail value of six hundred Canadian dollars (CDN $600.00).

    11. The Grouse Mountain Prize package consists of:

      1. two (2) adult annual pass to Grouse Mountain,

      2. two (2) Grouse Mountain ski/snowboard day lift tickets, and

      3. two (2) adult fare 3-zone Compass DayPasses for one (1) day.

      The Grouse Mountain Prize package has an approximate retail value of six hundred Canadian dollars (CDN $600.00).

    12. The Science World Prize package consists of:

      1. one (1) annual family membership to Science World in Vancouver, and

      2. two (2) adult fare 3-zone Compass DayPasses for one (1) day.

      The Science World Prize package has an approximate retail value of three hundred Canadian dollars (CDN $300.00).

    13. The Vancouver City Seaplane Tour Prize package consists of:

      1. two (2) vouchers for Harbour Air City Tours redeemable within one year of issuance of the vouchers for a Vancouver Extended Panorama City Tour,

      2. two (2) adult fare 3-zone Compass DayPasses for one (1) day.

      The Vancouver City Seaplane Tour Prize package has an approximate retail value of six hundred Canadian dollars (CDN $600.00).

    14. The Grand Prize consists of:

      One (1) adult fare 3-zone Compass Monthly Card for 60 months (loaded by TransLink on a monthly basis).

      The Grand Prize has an approximate retail value of eleven thousand nine hundred and forty-one Canadian dollars (CDN $11,941), based on 2023-2028 anticipated annual fare pricing set out in TransLink’s 2022 Investment Plan.

      15. The total number of available Prizes remaining to be won will decrease as each Weekly Prize Draw (defined below) is held.

      PRIZE CONDITIONS

      1. All prizes are non-transferable and non-assignable. Prizes must be accepted as awarded and cannot be substituted or redeemed for cash except in the sole discretion of TransLink. Prize winners are not entitled to any monetary difference between actual Prize value and stated approximate Prize value, if any.

      2. All hotel, restaurant and attractions Prizes require bookings and/or reservations. All such Prizes are subject to availability at time of booking. Blackout dates may apply (vary by voucher type). A credit card is required for all hotel bookings and must be presented upon check-in for any additional charges and incidentals not included in the voucher.

      3. Prizes must be redeemed by December 15, 2024 unless otherwise specified in the terms and conditions specific to any applicable Prize. Should a Prize winner be unable to participate on the dates and times designated by TransLink, the Prize will be forfeited and either awarded to an alternate winner or not awarded in TransLink’s sole discretion.

      4. Compass Card Prizes, including Compass Monthly Passes, Compass DayPasses and the Grand Prize, are all subject to the Compass Card Terms and Conditions of Use as outlined here: https://www.compasscard.ca/TermsAndConditions and the Transit Tariff as outlined here: https://www.translink.ca/-/media/translink/documents/about-translink/governance-and-board/bylaws/unofficial-consolidated-tariff-bylaw.pdf. Travel on the West Coast Express is not included with any Compass Card Prizes. Compass Card Prizes will automatically be loaded with value by TransLink. The Grand Prize Compass Card will consist of a Compass Card loaded with an adult fare 3-zone Monthly Pass loaded automatically by TransLink on a monthly basis for sixty (60) months.

      5. Winners of the Car Sharing Prizes will be required to create and/or hold an account with Evo and agree and adhere to the Evo Member Agreement terms and conditions as outlined here: https://evo.ca/member-agreement, including eligibility requirements such as the requirement to hold a valid Drivers Licence. Winners of the Car Sharing Prizes will be required to provide a valid, authorized credit card in order to create and hold a membership account with Evo. It is the Car Sharing Prize winner’s responsibility to manage its own account with Evo, including, if desired, by suspending or cancelling the account in accordance with Evo’s terms and conditions before annual charges are incurred after the first year or before charges are incurred beyond the value of the Prize voucher. The winner of the Car Sharing Prize will be responsible for all charges on their Evo account beyond the amount of the Car Sharing Prize voucher. Unused Prize credit on the winner’s Evo account will not expire, but will be subject to annual administration and insurance fees. Without limiting any other provision of these Contest rules, if the selected winner cannot open or hold an account with Evo for any reason, the Car Sharing Prize will be forfeited, have no cash value and TransLink shall have no obligation to provide either an alternative or value-in-kind, and in TransLink’s sole discretion another entrant may be selected from eligible entries for the applicable Prize draw in TransLink’s sole discretion until such time as a potential winner satisfies the terms set out in these Contest rules.

      6. The winner of the Bike Sharing Prize will be required to create and/or hold an account with Vancouver Bike Share Inc. (Mobi by Shaw Go) (“Mobi”) and agree and adhere to Mobi’s terms and conditions which are accessible during registration for an account at the following website: https://www.mobibikes.ca/, including eligibility requirements. The winner of the Bike Sharing Prize will be required to provide a valid and authorized credit card in order to create and hold an account with Mobi. The Bike Sharing Prize consists of an annual pass that automatically renews every year. It is the Bike Sharing Prize winner’s responsibility to manage its own account with Mobi including, if desired, by removing automatic renewal or cancelling the pass in accordance with Mobi’s terms and conditions before annual charges are incurred beyond the first year or before charges are incurred beyond the value of the Prize voucher. The winner of the Bike Sharing Prize will be responsible for all charges on their bike sharing account beyond the amount of the Bike Sharing Prize voucher. Riders of Mobi e-bikes must be 19 years of age or older. Riders of Mobi classic bikes must be 12 years of age or older and supervised in accordance with the Mobi terms and conditions. Mobi account holders are required to be 19 years of age or older; if a selected winner of the Bike Sharing Prize is a minor, a parent or guardian must open the Mobi account on the selected Prize winner’s behalf in order for the selected winner to claim the Prize. If a parent or guardian cannot or will not agree to open a Mobi account on behalf of a potential winner who is a minor within 7 days of the potential winner acknowledging their eligibility for the Prize as contemplated in these Contest rules, or if a potential winner of any age cannot open or hold an account with Mobi for any other reason, the Bike Sharing Prize will be forfeited, have no cash value and TransLink shall have no obligation to provide either an alternative or value-in-kind, and in TransLink’s sole discretion another entrant may be selected from eligible entries for the applicable Prize draw in TransLink’s sole discretion until such time as a potential winner satisfies the terms set out in these Contest rules. Unused Prize credit on the winner’s Mobi account will not expire, but will be subject to annual administration fees.

      7. Prize winners will be responsible for any other expense not explicitly included in the Prize, including without limitation parking fees. For Prizes that include a hotel stay, excluded expenses include but are not limited to transportation to and from residence/hotel, parking, taxes, gratuities, telephone calls, and in-room charges. Winners may be required to present a valid major credit card upon check-in at the hotel to cover any expenses over and above the standard room charge.

      8. If a Prize winner of a hotel stay is a minor, the Prize winner’s guest must be the Prize winner’s parent/legal guardian. Guests of Prize winners of hotel stays may be required to be of the age of majority or older in their province or territory of residence, and comply with these Contest rules and sign and return the Prize Winner Agreement (defined and described below).

      9. TransLink will select the applicable game for the Vancouver Giants and Vancouver Whitecaps tickets in TransLink’s sole discretion. The game selected for the BC Lions tickets is subject to change at the sole discretion of TransLink.

      10. Winners are solely responsible for the reporting and payment of all taxes, if any, that may result from claiming a prize in this Contest.

      11. Without limiting any other provision of these Contest rules, the terms and conditions by which gift cards, vouchers, annual passes and memberships may be redeemed and used are governed by the individual retailer or service provider. TransLink is not responsible for administering or ensuring compliance with the terms and conditions relating to gift cards, vouchers, annual passes and memberships.

      12. Winners must abide by all COVID-19 requirements applicable to their Prize, if any, including proof of vaccination or wearing a mask at the times throughout public spaces as may be required.

      13. Prizes must be accepted as awarded and cannot be transferred, assigned, substituted or redeemed for cash, except at the sole discretion of TransLink. Any unused, unclaimed or declined portion of any Prize will be forfeited, have no cash value and TransLink shall have no obligation to provide either an alternative or value-in-kind. TransLink reserves the right, in its sole discretion, to substitute a prize of equal or greater value if a Prize (or any portion thereof) cannot be awarded for any reason.

      14. Prizes will not be shipped to the winner by TransLink except in the sole discretion of TransLink. Winners must arrange for pick-up or shipping at their own cost and risk.

      15. Shipped Prizes will not be insured. TransLink and its representatives will not assume any liability for lost, damaged or misdirected Prizes.

      SELECTION OF WINNING ENTRIES AND WINNER NOTIFICATION

      Sixty Four (64) winners shall be selected as follows:

      1. On or about August 29, 2023 in Burnaby, British Columbia, six (6) entrants will be selected by a random draw from all eligible entries received between the start of the Contest Period and August 25, 2023 at 11:59 p.m. (PT) as the winners of three (3) of the Compass Monthly Pass Prizes, one (1) of the Transit Merchandise Prize packages, one (1) of the Stay + Play Prize packages and one (1) of the Electric Bike Prizes.

      2. On or about September 6, 2023 in Burnaby, British Columbia, seven (7) entrants will be selected by a random draw from all eligible entries received between August 26, 2023 at 12:00 a.m. (PT) and September 2, 2023 at 11:59 p.m. (PT) as the winners of three (3) of the Compass Monthly Pass Prizes, one (1) of the Transit Merchandise Prize packages, one (1) Stay + Play Prizes, one (1) of the Electric Scooter Prizes and the BC Lions Prize package.

      3. On or about September 12, 2023 in Burnaby, British Columbia, six (6) entrants will be selected by a random draw from all eligible entries received between September 3, 2023 at 12:00:01 a.m. (PT) and September 9, 2023 at 11:59 p.m. (PT) as the winners of three (3) of the Compass Monthly Pass Prizes, one (1) of the Transit Merchandise Prizes packages, one (1) of the Stay + Play Prize packages and one (1) of the Car Sharing Prizes.

      4. On or about September 19, 2023 in Burnaby, British Columbia, seven (7) entrants will be selected by a random draw from all eligible entries received between September 10, 2023 at 12:00 a.m. (PT) and September 16, 2023 at 11:59 p.m. (PT) as the winners of three (3) of the Compass Monthly Pass Prizes, one (1) of the Transit Merchandise Prize packages, one (1) of the Stay + Play Prize packages, the Vancouver City Seaplane Tour Prize package and the Bike Sharing Prize package.

      5. On or about September 26, 2023 in Burnaby, British Columbia, six (6) entrants will be selected by a random draw from all eligible entries received between September 17, 2023 at 12:00 a.m. (PT) and September 23, 2023 at 11:59 p.m. (PT) as the winners of three (3) of the Compass Monthly Pass Prizes, one (1) of the Transit Merchandise Prize packages, one (1) of the Stay + Play Prize packages and the Vancouver Whitecaps Prize package.

      6. On or about October 4, 2023 in Burnaby, British Columbia, six (6) entrants will be selected by a random draw from all eligible entries received between September 24, 2023 at 12:00 a.m. (PT) and September 30, 2023 at 11:59 p.m. (PT) as the winners of three (3) of the Compass Monthly Pass Prizes, one (1) of the Transit Merchandise Prize packages, one (1) of the Stay + Play Prize packages and the Science World Prize package.

      7. On or about October 11, 2023 in Burnaby, British Columbia, six (6) entrants will be selected by a random draw from all eligible entries received between October 1, 2023 at 12:00 a.m. (PT) and October 7, 2023 at 11:59 p.m. (PT) as the winners of three (3) of the Compass Monthly Pass Prizes, one (1) of the Transit Merchandise Prize packages, one (1) of the Stay + Play Prize packages and the final Car Sharing Prize.

      8. On or about October 17, 2023 in Burnaby, British Columbia, six (6) entrants will be selected by a random draw from all eligible entries received between October 8, 2023 at 12:00 a.m. (PT) and October 14, 2023 at 11:59 p.m. (PT) as the winners of three (3) of the Compass Monthly Pass Prizes, one (1) of the Transit Merchandise Prize packages, one (1) of the Stay + Play Prize packages and the final Electric Scooter Prize.

      9. On or about October 24, 2023 in Burnaby, British Columbia, seven (7) entrants will be selected by a random draw from all eligible entries received between October 15, 2023 at 12:00 a.m. (PT) and October 21, 2023 at 11:59 p.m. (PT) as the winners of three (3) of the Compass Monthly Pass Prizes, one (1) of the Transit Merchandise Prize packages, one (1) of the Stay + Play Prize packages, the final Electric Bike Prize and the Vancouver Giants Prize package.

      10. On or about October 31, 2023 in Burnaby, British Columbia, six (6) entrants will be selected by a random draw from all eligible entries received between October 22, 2023 at 12:00 a.m. (PT) and October 28, 2023 at 11:59 p.m. (PT) as the winners of the final three (3) of the Compass Monthly Pass Prizes, the final Transit Merchandise Prize package, the final Stay + Play Prize package and the Grouse Mountain Prize package.

      11. On or about November 2, 2023 in Burnaby, British Columbia, one (1) entrant will be selected by a random draw from all eligible entries received during the Contest Period as the Grand Prize winner.

      Each entrant shall be eligible to win only one (1) Prize per week in the weekly Prize draws listed in paragraphs (a) to (k) above) (“Weekly Prize Draws”). If an entrant is selected as a winner in a Weekly Prize Draw, the entrant will be disqualified from winning any subsequent Prizes in the same Weekly Prize Draw and another entrant will be selected by random draw for the subsequent Prizes. Entrants who are selected as a winner in a Weekly Prize Draw remain eligible to win Prizes in subsequent Weekly Prize Draws. All eligible entrants, including winners of one or more Weekly Prize Draws, shall be eligible to win the Grand Prize. The odds of being selected as a potential winner are dependent upon the number of eligible entries received by TransLink during the applicable time period specified for each draw.

      EACH SELECTED ENTRANT WILL BE NOTIFIED BY E-MAIL AND/OR PHONE THE DAY OF THE DRAW AT OR AROUND 5:00 P.M. AND MUST RESPOND WITHIN THREE (3) BUSINESS DAYS OF NOTIFICATION. Upon notification, the selected entrant must respond by telephone or e-mail (as specified in the notification) to the contact number or e-mail address provided within three (3) business days. If the selected entrant does not respond accordingly, they will be disqualified and will not receive a Prize and another entrant may be selected from eligible entries for the applicable Prize draw in TransLink’s sole discretion until such time as an entrant satisfies the terms set out in these Contest rules. TransLink is not responsible for the failure for any reason whatsoever of a selected entrant to receive notification or for TransLink to receive a selected entrant’s response.

      If, as a result of an error relating to the entry process, drawing or any other aspect of the Contest, there are more selected entrants than contemplated in these Contest rules, there will be a random draw amongst all eligible Prize claimants after the end of the Contest Period to award the correct number of Prizes.

      To be declared a winner, the selected entrant must, in addition to satisfying any other conditions of these Contest rules:

      1. First correctly answer, without assistance of any kind, whether mechanical or otherwise, a time-limited, mathematical skill-testing question which will be included in the Prize Winner Agreement, defined below;

      2. Sign and return an agreement (the “Prize Winner Agreement”),in a form acceptable to TransLink in its sole discretion, confirming compliance with these Contest rules and acceptance of the applicable Prize as offered and releasing and indemnifying and holding harmless TransLink, its subsidiaries, and each of their respective employees, directors, officers, suppliers, agents, sponsors (including Prize sponsors), administrators, licensees and representatives for any loss, harm, damages, cost or expense arising out of, or in any way connected to, directly or indirectly, the selected entrant’s participation in the Contest, any breach of these Contest rules, participation in any Contest-related activity, any breach of the Prize Winner Agreement, and the acceptance, possession, use or misuse of the applicable Prize or any component thereof, including without limitation, costs, injuries, losses related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom, to the extent permitted by law, and assuming liability for injuries caused or claimed by participating in the Contest or by the acceptance, possession, use or misuse of, or failure to receive the Prize or any component of the Prize; and

      3. Consent to their name, image (including without limitation any image or photograph of the potential winner together with the Prize), likeness, voice, biography, city/town of residence and comments, in whole or in part, modified or altered, either by themselves or in conjunction with other information, in any and all media now known or hereafter devised, for promotional, advertising and publicity purposes and in connection with the Contest and the promotion and exploitation thereof. Such consent will be included in the Prize Winner Agreement.

      If the selected entrant is a minor in British Columbia, to be declared a winner, in addition to satisfying any other conditions of these Contest rules, the selected entrant’s parent or guardian must also sign and return the Prize Winner Agreement described above in addition to the selected entrant.

      If the selected entrant fails to meet these conditions within 7 days of acknowledging his/her receipt of the notification of eligibility for a Prize, the Prize will be forfeited and another entrant may be selected from eligible entries for the applicable Prize draw in TransLink’s sole discretion until such time as an entrant satisfies the terms set out in these Contest rules. Failure to comply with any other terms or conditions of these Contest rules may, at the sole discretion of TransLink, result in the winner’s disqualification and the forfeiture of their interest in the applicable Prize(s).

      TransLink or TransLink’s representative will contact the Prize winners to coordinate the provision of the Prizes within three (3) days once such winners have been successfully contacted and notified of their Prize and fulfilled the requirements set out in these Contest rules. If Prize winners are responsible for picking up their Prize, they must do so by the deadline and at the location specified by TransLink or TransLink’s representative. Failure to do so may result in forfeiture of the Prize.

      GENERAL TERMS AND CONDITIONS

      The Contest will be run in accordance with these Contest rules. Entrants must comply with these Contest rules, and will be deemed to have received and understood these Contest rules by submitting an entry.

      The odds of winning a prize draw are dependent upon the number of eligible entries received during the Contest Period prior to the cutoff date and time for the applicable prize draw.

      TransLink’s records of trips taken by an entrant using their Compass Card will be final and binding.

      TransLink will not, under any circumstances, be responsible for, or liable to any entrant or any other person for:

      • any erroneous lost, damaged, late, incomplete, misdirected, deleted, defective, or altered Contest entries, regardless of the cause, including, but not limited to, failure of the Contest Site;

      • any failure for any reason whatsoever of the selected entrant to receive a prize notification; any changes in email addresses or phone numbers after Contest entries are submitted;

      • any computer, online, telephone, or technical malfunctions or errors that may occur, regardless of the cause; and

      • any inability to conduct the Contest as planned for any reason, including reasons beyond the control of TransLink.

      The decision of TransLink is final on all matters of fact, interpretation, eligibility, procedure and fulfillment in all matters related to this Contest and without appeal.

      TransLink reserves the right to require proof of age, address and jurisdiction of residence prior to awarding any Prize.

      TransLink may, at its sole discretion, alter, amend, suspend, or cancel this Contest or these Contest rules, or amend the draw procedures at any time, subject to applicable law.

      By participating in this Contest, the entrant agrees to release, indemnify and hold harmless TransLink, its subsidiaries, prize suppliers, and each of their directors, officers, employees, contractors and agents from any and all losses, damages, rights, claims and action of any kind in connection with this Contest or resulting from the entrant’s acceptance, possession, or use of any Prize, including without limitation, personal injury, death, or property damage.

      This Contest is in no way sponsored, endorsed or administered by any social media platforms on which the Contest may have been promoted and/or publicized. Any questions, comments or complaints regarding the Contest must be directed to TransLink.

      These are the official Contest rules. This Contest is subject to the laws of the province of British Columbia and the laws of Canada applicable herein. If any provisions of these Contest rules are held to be invalid or unenforceable by a court of competent jurisdiction, all remaining provisions hereof will remain in full force and effect.

      In the event of a dispute concerning the identity of an entrant, the entrant will be the registered account holder of the email address associated with the disputed entry, but only if that person meets all other eligibility criteria.

      PRIVACY

      The personal information requested on the registration page and captured through your transit trip entries is collected by TransLink for the management of its marketing, communications, and promotions programs, including administration of the TransLink Tap in to Win Sweepstakes. This is done in accordance with s. 26(c) of the Freedom of Information and Protection of Privacy Act.
